ORDER 1. Heard. The applicant has moved this application under Section 439 of the Cr. P.C. for grant of regular bail, who has been arrested on 27-8-2014 in connection with Crime No. 382 of 2014 registered at Police Station Bhilai Nagar, District Durg, for the offence punishable under Sections 363, 366(A) and 376 of the IPC and Sections 5 & 6 of Protection of Children from Sexual Offences Act, 2012. 2. The allegation of the prosecution is that the applicant abducted the prosecutrix Ku. Acharaj Kaur and committed sexual intercourse with her by taking her away from the lawful guardianship of her parents and thereby committed the aforesaid offences. 3. Learned counsel appearing for the applicant would submit that the applicant is in jail since 27-8-2014 and the statements of parents of the prosecutrix were recorded before the jurisdictional criminal Court in which they have been declared and have not supported the case of the prosecution as prosecutrix Achraj Kaur had gone to Nagpur which is her sister's place. Therefore, the applicant is entitled to be released on bail. 4. On the other hand, learned State counsel opposed the application for grant of bail. 5. Taking into consideration the facts and circumstances of the case, considering the statements of the parents of the prosecutrix recorded by the trial Court and further taking into consideration that the applicant is in jail since 27-8-2014, I consider it to be a fit case for releasing the applicant on bail. Accordingly, the application is allowed. It is ordered that applicant shall be released on bail on his furnishing a personal bond of Rs. 25,000/- along with one local surety of the like amount to the satisfaction of the trial Court. He shall appear before the trial court on each and every date given to him by the said Court till disposal of the trial.
