JUDGMENT M. VENUGOPAL, J. 1. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent. 2. According to the petitioner, as a registered contractor with the office of the respondent, he had decided to take part in the tender process for the work covered in Serial No. 5 in Division – I, II, III and IV for Thar Road works by using plastic residues in Thumbalam in Mavilipatti Road, Trichy District. The last date for submission of the tender schedule form is 30.10.2014 at about 3.00 p.m. The sealed tenders would be opened on 30.10.2014 at about 3.30 p.m. by the respondent. 3. The version projected by the petitioner is that in order to participate in the tender, on 23.10.2014, he took a demand draft for a sum of Rs. 6,300/- each for the aforesaid works and sent the application on 23.10.2014 along with demand draft and requested the respondent to issue the tender schedule form by registered post. Even after receipt of his application and also the demand draft, the respondent had not issued the tender schedule form to the petitioner. As such, he was proffered to project the detailed representation on 23.10.2014 to the respondent by registered post. But no reply was sent by the respondent till today. 4. The grievance of the petitioner is that the respondent is to open the tender schedule form on 30.10.2014 at about 3.30 p.m. and as such, he prays for issuance of direction by this Court in directing the respondent to conduct the tender process for laying Thar Road Works in Thumbalam to Mavilipatti Road by using plastic residues in Trichy District pertaining to Serial No. 5, Division – I to IV of the District Tender Bulletin, Trichy District dated 16.10.2014 by issuing tender schedule form to the petitioner and conduct the tender process in accordance with law. 5.

In view of the fact that the request of the petitioner in the present writ petition is to consider his representation dated 23.10.2014 for issuance of tender schedule form to him in regard to the tender to be conducted on 30.10.2014 at 3.00 p.m. this Court in the interest of justice, fair play directs the respondent to consider the representation of the petitioner as stated supra and to issue the tender schedule form to the petitioner forthwith and to proceed further in the manner known to law and in accordance with law. It is made clear that the respondent should obey the order of this Court passed in the writ petition in true letter and spirit. 6. With the aforesaid direction, the Writ Petition stands disposed of. No costs. Consequently, the connected Miscellaneous Petition is closed.
