ORDER : Sanjay K. Agrawal, J. 1. Heard finally. The applicants have moved this application under Section 439 of the Cr. P.C. for grant of regular bail in connection with Crime No. 244/2014 registered at Police Station City Kotwali, District Balodabazar-Bhatapara for offence punishable under Sections 376, 363, 366, 368, 506(B) of the I.P.C. and Sections 17, 18 and 4 of the Protection of Children from Sexual Offences Act, 2012. 2. The allegation against the present applicants is that on 23-05-2014, co-accused Aarti Dewar @ Rahul along with Premlal kidnapped complainant Ku. Megha Yadav from her Village Karmada, Police Station Balodabazar, District Balodabazar-Bhatapara and thereafter, co-accused Aarti Dewar @ Rahul committed sexual intercourse with her and the present applicants allowed them to stay in their house. 3. Learned counsel appearing for the applicants would submit that the prosecution case is that co-accused Aarti Dewar alias Rahul along with Premlal kidnapped Ku. Megha Yadav and thereafter Aarti Dewar alias Rahul committed sexual intercourse with her. The only allegation against the present applicants, is that they allowed co-accused Aarti Dewar alias Rahul and Premlal to stay in their house. Applicant Smt. Rajani Dewar is in jail since 16-06-2014 and applicant Smt. Mona alias Mina Dewar is in jail since 22-08-2014. Challan has already been filed and kidnapper Premlal has already been released on bail by the trial Court. 4. The application for bail is opposed by learned counsel appearing for the State. 5. Tanking into consideration that the actual kidnapping was alleged to, have been done by co-accused Aarti Dewar alias Rahul and Premlal and the sexual intercourse was alleged to have been done by co-accused Aarti Dewar alias Rahul and the present applicants are sisters of co-accused Aarti Dewar alias Rahul, applicant Smt. Rajani Dewar is in jail since 16-06-2014 and applicant Smt. Mona alias Mina Dewar is in jail since 22-08-2014, both the applicants are women and charge-sheet has been filed, I am of the considered opinion that it is a fit case for release of the applicants on bail. Accordingly, the application is allowed. It is ordered that the applicants shall be released on ball on each of them furnishing a personal bond for a sum of Rs. 25,000/- with one local solvent surety of the like amount to the satisfaction of the trial Court.
