Judgment : Mr. C.S.Vaidyanathan, learned senior counsel for the respondent has filed an affidavit pursuant to our order dated 26.03.2014. He has also separately filed in a sealed cover a list of names of persons who are according to Mr. Vaidyanathan required to be investigated in view of the disclosures made and the evidence collected sofar by the Investigating Agency. The basis on which the Investigating Agency has named the persons in the list is not however evident from the list. Mr. Vaidyanathan, therefore, offers to file a synopsis of the basis on which the names mentioned in the list have been included in the said list and the evidence which incriminates them calling for further investigation into their role and conduct. We see no reason to decline the prayer for time to enable Mr. Vaidyanathan to do the needful which may be done on or before 16.04.2014. Post on 16.04.2014 for continuation. List of names furnished by Mr. Vaidyanathan in the sealed covered shall be kept in a sealed cover by the Registry. An affidavit has been filed by the State of Odisha pursuant to our direction dated 26.03.2014 in which the State has identified three independent FIRs in which the larger conspiracy angle is being investigated. Copies of the affidavit shall be furnished to Mr. Siddharth Luthra, learned ASG for the CBI and Mr. Alok Jena who may respond to the same within one week. Post again on 23.04.2014. Mr. Suresh Chandra Tripathy, learned counsel for the petitioner seeks permission to retire. He is permitted to do so. Mr. Alok Jena may make alternative arrangement or apply for appointment of an Amicus Curiae, if so advised.
