Judgment 1. This miscellaneous petition has been filed praying that this Court may be pleased to modify the order, dated 3.8.2012, by suitably expunging the remarks made against the counsel on record, in W.P.No.22606 of 2010. 2. This Court had passed an order, dated 3.8.2012, in W.P.No.22606 of 2010, making certain remarks against the counsel on record, for indulging in 'Forum Shopping'. The counsel on record had filed an affidavit, dated 16.10.2014, regretting his action and stating that he would not involve himself in such activities, in future, which may have the effect of lowering the image of the Judiciary. 3. Mr. R.C. Paul Kanagaraj, the learned counsel, who had appeared on behalf of the counsel on record in the writ petition, in W.P.No.22606 of 2010, had submitted that he would ensure that the undertaking given by the counsel on record, namely, Mr. S. Mahaveer Shivaji, in his affidavit, dated 16.10.2014, is complied with. 4. Mr. R.C. Paul Kanagaraj, the learned counsel appearing on behalf of the petitioner in the writ petition, in W.P.No.22606 of 2010, as well as the learned counsels appearing on behalf of the respondents had no objection for this Court passing appropriate orders, as this Court deems fit. 5. In such circumstances, this Court finds it appropriate to hold that, in view of the affidavit, dated 16.10.2014, filed by Mr. S. Mahaveer Shivaji, the learned counsel on record, in W.P.No.22606 of 2010, no further proceedings need not be initiated against him, by the Bar Council of Tamil Nadu. This petition is ordered with the above observations.
