ORDER 1. The present petition has been filed for issuance of an appropriate writ, order or direction directing the Claims Tribunal to pay a sum of Rs.2 lacs to the petitioners who are legal heirs of the deceased. 2. In the present case a total sum of Rs.6,35,000/- has been kept in fixed deposit and a sum of Rs.95,000/- has been paid to the petitioners. The contention of the petitioner No.1 is that so far as the amount which has been kept in the fixed deposit in respect of minors should not be touched, however the amount which has been kept in the fixed deposit in the name of the petitioner No.1 be released, enabling the petitioners to pay the loan amount and also to meet other expenses. 3. Heard Shri Sanjay Mehra, learned counsel appearing for the Insurance Company. 4. Keeping in view the totality of the circumstances of the case, the present petition is allowed. The Claims Tribunal is directed to release the FDR, which is in the name of the petitioner No.1 within a period of 30 days from the date of receipt of a certified copy of this order. 5. With the aforesaid, the writ petition stands disposed of.
