Judgment : (A.M. Sapre, C.J.) A detailed order was passed in Misc. Case No.3819 of 2013 on 10.3.2014, which reads as under :- “Heard Mr NJ Khataniar, learned counsel for the applicant-petitioner. Also heard Mr KN Chowdhury, learned Addl. Advocate General, Assam and Mr R Sarma, learned Asstt. Solicitor General of India for the respondents. This is an application made by respondent Nos. 1 to 6 praying therein for modification of the interim order dated 1.3.2013 which reads as under :- “Mr. B.J. Talukdar, learned Govt. Advocate, Assam, seeks time to file response on behalf of respondent No.9. In the meanwhile, arrangement under which the road is open from 7.00 AM to 7.00 P.M. which is operative upto March 5. 2013 may continue till March 12.2013. Learned counsel for the State may also get a map showing the area allotted to Army. List for further consideration on March 11. 2013, as prayed.”. Notice of this application was served upon the petitioners as also on the State counsel with a view to find out as to whether any case is made out for modification of the order dated 1.3.2013 quoted above. Replies have been filed. After having heard the learned counsel for the parties and indeed the learned counsel for the parties also agree and further even otherwise also we are satisfied that a case for modification of the interim order dated 1.3.2013 is made out in the light of the averments made in the application under consideration. Accordingly and in the light of the agreement between the parties and further we also consider it just and proper and in the interest of all that the order dated 1.3.2013 deserves to be modified as under: 1. The State will provide in consultation with Airport Authority adequate security and patrolling on the road in question at all suitable/sensitive places on the said road to keep check/vigil on the movement of persons using the road between 7 a.m. to 7 p.m. 2. The security personnel shall consist of male/female constables/ police personnel at all times for doing patrolling and checking on the road in question. 3.

Construction of the alternative roads as shown in the map annexed with the affidavit dated 11.2.2014 as Annexure-I in “orange colour” and in “blue colour” shall be completed positively by the State on priority basis as an outer limit on or before 31.3.2015 to avoid any public inconvenience and further keeping in mind security aspects of the Airport. It is with these directions, the application under consideration made by respondent Nos. 1 to 6 stands accordingly disposed of. The parties are however granted liberty to approach this Court for any modification, if required, depending upon the exigencies.” Mr. N.J. Khataniar, learned counsel for the petitioner and Mr. K.N. Choudhury, learned Additional Advocate General, Assam submitted that in Clause (1) the said order, in place of the words “Airport Authority”, the words – “Indian Air Force” should have been typed. We accept the prayer and this being a typographical error, the word “Airport Authority” be deleted from Clause (1) of the aforesaid order and in its place, the words “Indian Air Force” be read. All other directions contained in the said order would remain as it is. Learned counsel for the parties then submitted that in the light of the detailed order dated 10.3.2014 passed in Misc. Case No.3819 of 2013, this PIL can be disposed of because the purpose of PIL has since been achieved with the passing of the detailed order on 10.3.2014 in Misc. Case No.3819 of 2013. On perusal of the records of the case, we are inclined to accept this submission and, accordingly, we direct that the order dated 10.3.2014 be now treated to be an order as if it is passed in the PIL and, accordingly, this PIL stands disposed of in the light of the order dated 10.3.2014, with the aforesaid modification mentioned (supra). No cost.
