ORDER 1. The present petition has been filed for issuance of an appropriate writ, order or direction directing the Claims Tribunal to release a sum of Rs.2 lacs, which has been deposited in a fixed deposit on account of award passed in the Lok Adalat dated 30.11.2013 in Case No.360/2012. 2. The facts of the case reveal that the petitioner has suffered serious injuries in spinal cord as well as head injuries and he is under treatment. It has been stated that in the Lok Adalat a sum of Rs.5 lacs has been awarded and out of the same only Rs.1 lac has been given to the petitioner and remaining amount i.e. Rs.4 lacs has been kept in a fixed deposit, however the petitioner has to clear medical bills and needs money for further treatment. 3. Heard Shri Sanjay Mehra, learned counsel appearing for the Insurance Company. 4. This Court keeping in view the totality of the circumstances of the case, is of the considered opinion that as the petitioner is in a need of money for his treatment and he has already incurred an expense of Rs.3 lacs towards his treatment is certainly entitled for further amount for his treatment and therefore, it is directed that the petitioner be paid a sum of Rs.2 lacs out of the fixed deposit and the rest of the amount be kept in the fixed deposit. 5. With the aforesaid, the writ petition stands deposed of. 6. No order as to costs.
