The learned counsel for the petitioner submitted that the impugned Government Order is contrary to the order passed by the Supreme Court in Civil Appeal No.4187 of 2009. 3. Contrary to the said decision, the petitioner has been left out, by adopting a different yardstick and without taking into consideration the original seniority of the petitioner, the vacancies are sought to be filled up. 4. Considering the said submission of the learned counsel for the petitioner, the respondents are directed to keep one post vacant.
