ORDER Sanjay K. Agrawal, J. 1. Heard. The applicant has moved this application under Section 439 of the Cr.P.C. for grant of regular bail in connection with Crime No. 174/2014 registered at Police Station Bilaigarh, District Balodabazar for offence punishable under Sections 363, 366, 376 of the IPC and 6 of the Protection of Children from Sexual Offences Act, 2012. 2. Case of the prosecution is that on 06-06-2014, the applicant kidnapped Ku. Kritika Sahu, aged about 17 years, thereafter, she was taken to Orissa, Jammu & Kashmir where the applicant committed sexual intercourse with her and thereby committed the offence. 3. Learned counsel appearing for the applicant submits that immediately after the incident the applicant married with the prosecutrix and they resided together as husband and wife. Learned counsel further submits that the applicant is in jail since 12-08-2014, therefore, he may be released on bail. 4. On the other hand, learned counsel appearing for tie State opposed the application for bail. 5. Taking into consideration the facts and circumstances of the case, further taking into consideration that after the incident, the applicant married with the prosecutrix and thereafter, they were resided together as husband and wife and the applicant is in jail since 12-08-2014. I consider it a fit case for release of the applicant on bail. Accordingly, the application is allowed, it is ordered that the applicant shall be released on bail on his furnishing a personal bond of Rs. 25,000/- along with one surety of the like amount to tie satisfaction of the trial Court. He shall appear before the trial Court regularly on each and every date as and when given to him by the said Court till the trial is concluded. C.C. as per rules today.
