Judgment Sudhanshu Dhulia, J. (Oral) Heard Mr. G.S. Sandhu with Mr. Kishore Kumar, Advocates for the applicant and Ms. Mamta Joshi, learned Brief Holder for the State of Uttarakhand and Mr. Hari Mohan Bhatia, Advocate, for the complainant. The applicant is in jail since 25th February, 2014 having been implicated in F.I.R. No. 30 of 2014, which has been registered under Section 307 of I.P.C. at Police Station – Sitarganj, District – Udham Singh Nagar. According to the applicant, there are contradictions in the statements of PW1 and PW2 which have been recorded before the Trial Court. The First Information Report is delayed by four days and at this stage there is no chance of tampering the witnesses and, therefore, the applicant needs to be granted bail. The bail application is vehemently opposed by Mr. Hari Mohan Bhatia, learned counsel for the complainant. According to Mr. Bhatia there are serious injuries caused on vital parts of the body. Considering the overall evidence which is presently available before this Court, the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Jassa Singh) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Magistrate concerned. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings. It is also made clear that the trial court shall conclude the trial as early as possible without granting any unnecessary adjournment to any of the parties. On the request of learned counsel for the applicant, Registry is hereby directed to supply a certified copy of this order to the learned counsel for the applicant today itself on payment of usual charges.
