Judgment 1. The petitioners filed O.A.No.2016 of 2004, directing the respondents herein to confer the pension based upon the last pay drawn and send the revised proposals to the Accountant General based upon the last pay drawn by the individuals in the revised scale of pay of Rs. 4000-100-6000. On abolition of the Tribunal, the matter stood transferred to this Court and re-numbered as W.P.No.18326 of 2007. 2. The third respondent has filed a counter affidavit stating that the prayer of the petitioners was conceded and relief was granted. In paragraph 3 of the counter affidavit, it is averred as follows:- "3. It is submitted that based on frequent representations of the petitioners, the Assistant Executive Engineer, PWD, Cauvery Sub Division in this Pro.No.F.15/2005/EA/ 05.12.2006 refix the pay of the petitioners in the scale of pay of Rs.1200-30-1560-40-2040. Based on this fixation, Revised pension proposal sent to Accountant General, Chennai and AG admitted the pension proposal. The petitioners now enjoying the benefits of Engineering in Chief, WRO, Chennai Lr.No.S4(3)/65265/97 dated 13.05.1999." 3. In view of the same, nothing survives for adjudication in this writ petition. Accordingly, the writ petition stands closed. No costs.
