Judgment The matter lies in a narrow compass. The disciplinary authority straightaway passed the impugned order imposing the punishment, without issuing notice to the petitioner seeking his views on the differed views from that of the enquiry officer, when the enquiry officer held that the charges against the petitioner are not proved, and the said action of the disciplinary authority / respondent is in violation of the law laid down by the Apex Court in the judgment in Punjab National Bank V. Kunj Behari Misra, [ (1998) 7 SCC 84 ]. Hence, the impugned order is liable to be quashed. Accordingly, the impugned order is quashed. This writ petition is allowed. No costs.
