Judgment Sudhanshu Dhulia, J. Heard Mr. Vikas Bahuguna, learned counsel for the applicant, Mr. P.S. Saun, learned Deputy Advocate General for the State and perused the record. The applicant is in jail being implicated in Case Crime No. 126 of 2014, which has been registered under Sections 147/304/34 of I.P.C., P.S. Kotwali Cantt., District Dehradun. As per the prosecution, the allegation against the applicant and other accused persons is that they threw stones on Shankar Sah due to which he sustained injuries and subsequently died. The co-accused, namely, Nitin @ Saurab Thapa and Rishab Gurang have been granted bail by this Court vide orders dated 06.09.2014 and 06.08.2014 respectively. The role assigned to the present applicant also stands on a similar footing as that of the co-accused. The applicant is in jail since 12.07.2014. Considering the facts and circumstances of the case as well as the material available on record, the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Himanshu Thapa) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties of the equal amount to the satisfaction of the Magistrate concerned. It is made clear that any observations made by this Court are only for the purposes of grant of bail. It shall not be taken into consideration by the trial court. Let a certified copy of this order be supplied today itself to the learned counsel for the applicant on the payment of usual charges.
