Judgment : 1. The petitioner was working as an Accountant in Mailam Panchayat Union, South Arcot District at the relevant time. A charge memo dated 01.11.1999, levelling as many as four charges, was issued alleging that he abetted and aided the Block Development Officer in the purchase of power pumps spares. 2. The allegation is mainly against the Block Development Officer. It is not stated by the learned Additional Government Pleader as to what action was taken against the said Block Development Officer. 3. Further, the charge memo was issued after 13 years of the alleged occurrence that took place during 1986. The petitioner reached the age of superannuation in the year 1996 itself. After reaching the age of superannuation, the aforesaid charge memo was issued. Challenging the same, the petitioner has filed this Original Application. 4. Heard both sides. 5. It is admitted that no final order is passed on the charge memo dated 01.11.1999. As stated above, charge memo was issued after 13 years of the alleged occurrence. The matter is pending for the past 15 years. When the matter came up for admission before the Tribunal, no stay was granted by the Tribunal. But for reasons best known, no final order is passed even after 15 years. On this sole ground, the impugned charge memo is liable to be interfered with. 6. Accordingly, the impugned order dated 01.11.1999 is set aside and the writ petition is allowed. No costs.
