Judgment Hon’ble Sudhanshu Dhulia, J. (Oral) Heard Mr. Lalit Sharma, Advocate for the applicants and Mr. P.S. Saun, learned Deputy Advocate General for the State of Uttarakhand. The applicants are in jail having been implicated in F.I.R. No.480 of 2014, which has been registered under Sections 147/148/149/323/336/307/504/153-A of I.P.C. and Section 7 of Criminal Law Amendment Act at Police Station – Haldwani, District – Nainital. Considering the overall evidence which is presently available before this Court, prima facie the applicants have been able to make out a case for bail. The bail application is accordingly allowed. Let the applicants (Manoj Sonkar and Banti Sonkar) be enlarged on bail in the aforesaid crime on their executing a personal bond each and two reliable sureties each of the equal amount to the satisfaction of the Magistrate concerned. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
