Judgment Sudhanshu Dhulia, J. (Oral) Counter affidavit filed today is taken on record. Heard Mr. R.P. Nautiyal, Senior Advocate assisted by Mr. B.S. Koranga, Advocate for the applicant and Ms. Mamta Joshi, learned Brief Holder for the State of Uttarakhand. The applicant is in jail since 28th May, 2014 having been implicated in Case Crime No.03 of 2014, which has been registered under Sections 8/13(1)(D) and 13 (2) of Prevention of Corruption Act, 1988 at Police Station – Vigilance Sector, Dehradun. According to the allegation in the First Information Report, the applicant was trapped while taking illegal gratification at a restaurant in Dehradun. According to the applicant, sanction which was earlier granted by the State Authorities has been withdrawn. Considering the overall evidence which is presently available before this Court, prima facie the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Sunil Kumar Mishra) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Special Judge/District Judge concerned. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
