Judgment: Heard on IA No.2872/2013, an application seeking condonation of delay in filing this appeal. The delay is of 213 days. 2. Having gone through the reasons assigned in the application, we find that the delay has not at all been satisfactorily explained. In the result, the application for condonation of delay is rejected. 3. However, we have also gone through the merits of the matter. 4. This writ appeal challenges the order dated 18.07.2012 passed by the learned Single Judge of this Court in Writ Petition No.7988/2011 (s), by which the learned Single Judge has set aside the recovery, which was sought to be made from the retiral benefits of the respondent on the ground that wrong pay fixation was done. 5. Undisputedly, the wrong pay fixation was not done on account of any misrepresentation or fraud being played by the writ petitioner (respondent herein). 6. During the course of arguments, learned Deputy Government Advocate stated that the proposed recovery after retirement was to the extent of nearly Rs.35,000/-7. Having gone through the order passed by the learned Single Judge, we find that on merits also no case for interfering in the matter in this intra court appeal is made out. 8. The writ appeal fails on the ground of limitation as also on merits.
