Judgment Servesh Kumar Gupta, J. Having heard learned Counsel for the parties, it transpires that a passenger bus en route from Champawat to Pithoragarh was intercepted by the forest officials/police and from the roof of the same, one suspicious holdall was recovered and opened wherein the skin of Class I Schedule lion/leopard was found. The driver and the conductor of the bus could not discover the owner of that holdall including skin nor the passengers sitting inside the bus claimed the same. So, both the driver and the conductor were apprehended by the police. Conductor was granted bail by the High Court and the driver was granted bail by the District Court. After few days of the above incident, this accused applicant Kheem Singh was arrested by the Investigation Officer because on his pointing out, the dead body of a leopard, which had been disintegrated, was found buried in the earth. A single barrel gun was recovered from his possession which was licensed gun and he admitted his guilt before the Investigation Officer regarding the shooting out of that wild animal. He is in gaol since 30.8.2014. Taking into consideration the want of an eyewitness of shooting out of such a Class I wild animal as well as the recovery of the skin contained holdall on the roof of the bus unclaimed, the accused applicant is granted bail in both the aforesaid offences. Both the bail applications are accordingly allowed. Let the applicant Kheem Singh be released on bail on furnishing a personal bond and two sureties, for each of the offences, to the satisfaction of the Court concerned.
