Judgment Sudhanshu Dhulia, J. (Oral) Supplementary affidavit is taken on record. Miscellaneous Application (I.A. No.3935 of 2014) stands disposed of. Heard Mr. Lalit Sharma, Advocate for the applicant and Mr. S.S. Adhikari, learned Assistant Government Advocate for the State of Uttarakhand. The applicant is in jail having been implicated in First Information Report No.391 of 2014/Case Crime No. 391 of 2014, which has been registered under Sections 328/376/354A/354D/506 of I.P.C. along with Section 4 of the Protection of Children From Sexual Offences Act, 2012 at Police Station – Haldwani, District Nainital. In the medical certificate the age of the prosecutrix is 18 years. Moreover, subsequent to the First Information Report, under Section 164 Cr.P.C., the prosecutrix has denied the allegation in the First Information Report. Considering the overall evidence which is presently available before this Court, prima facie the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Virendra Singh Rathore) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Special Judge/District Judge concerned. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
