Judgment Sudhanshu Dhulia, J. (Oral) Heard Mr. Tapan Singh, Advocate for the applicant and Mr. Arvind Vashistha, Senior Advocate, assisted by Ms. Monika Pant, for the Central Bureau of Investigation. The applicant is in jail since July, 2014 having been implicated in R.C. No.0072012A0008 (C.B.I. Case No.8A of 2013), ‘C.B.I. Vs. Naresh Kumar & others’, which has been registered under Sections 120B/420/468/471 of I.P.C. and Sections 13 (2) read with Section 13 (1) (d) Prevention of Corruption Act at Police Station – C.B.I./S.P.E, Dehradun. The co-accused has already been granted bail by this Court. Considering the overall evidence which is presently available before this Court, prima facie the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Naresh Kumar) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Special Judge/Sessions Judge concerned. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
