Judgment Sudhanshu Dhulia, J. Heard Ms. Pushpa Joshi, Senior Advocate assisted by Mr. Amit Kapri, Advocate for the applicant and Mr. B.M. Pingal, learned Brief Holder, for the State of Uttarakhand. The applicant is in jail having been implicated in F.I.R. No. 02 of 2014, which has been registered under Sections 7/13(1)(D) R/w 13(2) of Prevention of Corruption Act, Chalani Vigilance Nainital, Sector Haldwani, District Nainital. According to the applicant he has been falsely implicated. Moreover the work which is alleged to be done by the applicant for which favour was allegedly taken could not have been done by the applicant as the same was to be done by the superior authorities. Considering the overall evidence which is presently available before this Court, prima facie the applicant has been able to make out a case for bail. The bail application is accordingly allowed. Let the applicant (Satpal Singh) be enlarged on bail in the aforesaid crime on his executing a personal bond and two reliable sureties each of the equal amount to the satisfaction of the Special Judge (Anti Corruption)/Sessions Judge, Nainital. It is made clear that any observation made by this Court is only for the purpose of grant of bail. It shall not be taken into consideration at all in any other proceedings.
