ORDER 1. Through this letter petition, the petitioner has raised the issue regarding shortage and non-availability of wood, cow dung cake and other combustible material many a times at Juni Indore Mukti-Dham – a Cremation Centre for the dead bodies. 2. On being noticed, the respondents have filed reply. 3. According to the Indore Municipal Corporation, the aforesaid material for cremation of the dead bodies was being provided by ‘Shri Bada Sarafa Cotton Association, Indore’, as per the MOU between the IMC and the said Association. It has not been disputed that earlier on few occasions shortage of material was being occurred. It has been stated that now the material is being regularly provided by the newly reconstituted association of Shri Bada Sarafa Association, which is called as ‘Shri Balaji Ganesh Association’. 4. Having considered the submissions made by the parties and the reply along with the letter (Annexure R/1) and the photographs, we are inclined to dispose of this petition by directing the Collector, Indore and the Commissioner, Indore Municipal Corporation, Indore to depute a responsible officer from the Municipal Corporation, Indore, who shall keep constant vigil on the availability of said stock in the cremation centre and who shall ensure that there should not be any dearth of the material required for burning of the dead bodies. The said officer shall visit the cremation centre on daily basis and shall check the available stock and in case of shortage of any requisite material, he shall immediately get the material available from the said association and in case of any inability on the part of the said association, it will be the duty of the Municipal Corporation, Indore and the State Government to provide adequate quantity of the requisite material, so that in future there may not be any incident, as was happened on 14.4.2011. 5. The Collector, Indore and the Commissioner, Indore Municipal Corporation shall also ensure that the material necessary for burning of the dead bodies will be available at a reasonable cost. They are also directed to ensure the availability of other requisite amenities like water, sheds etc. and they shall make arrangement to keep cleanliness of the campus. 6.

It has also been apprised by the IMC that conversion of Electric Cremation Unit to gas operated (CNG) is in progress and the agency which has been awarded the conversion work and the maintenance has completed the work to the extent of 70%. We record this stand of the Corporation, which is supported by documents Annexure R/4 and R/5 and expect that the work will be completed within the stipulated period. 7. With the aforesaid observations and directions, we dispose of this writ petition.
