JUDGMENT Mrs. Sabina, J.:- Respondents had filed the petition under Section 13 of the East Punjab Urban Rent Restriction Act, 1949 as applicable to Chandigarh seeking ejectment of the petitioner. Learned Rent Controller vide order dated 26.9.2011 dismissed the ejectment petition. However, petitioner was directed to pay the remaining rent within a period two months. Aggrieved against the said order, petitioner as well as respondents preferred appeals. The Appellate Authority vide order dated 23.12.2013 allowed the appeal filed by the respondents and dismissed the appeal filed by the petitioner. Hence, the present petition by the petitioner-tenant. 2. Learned senior counsel for the petitioner has submitted that petitioner had filed an application under Order 41 Rule 27 of the Code of Civil Procedure, 1908 (‘CPC’ for short) before the Appellate Authority. Vide order dated 20.3.2013 the said application was ordered to be listed with the main appeal. Further, it was evident from order dated 2.12.2013 that arguments had also been addressed on the application for additional evidence but the Appellate Authority had failed to decide the application under Order 41 Rule 27 CPC while deciding the appeal. Learned senior counsel has further submitted that the impugned order passed by the Appellate Authority was liable to be set aside and the matter was liable to be remanded back to the Appellate Authority for deciding the appeal afresh along with the application under Order 41 Rule 27 CPC. In support of his arguments, learned senior counsel has placed reliance on ‘Ashok Kumar versus Surinder Kumar, AIR 2005 P&H 263 . 3. Learned senior counsel for respondent No. 1, on instructions from his clients, has not opposed the submissions made by the learned senior counsel for the petitioner. 4. In view of the above submissions by the senior counsel for the parties, this petition is allowed. Impugned order dated 23.12.2013 passed by the Appellate Authority, is set aside. Case is remanded back to the Appellate Authority with a direction to dispose of the appeal afresh along with the application under Order 41 Rule 27 CPC. 5.
