Judgment Sudhanshu Dhulia, J. 1. A First Information Report was lodged against the applicant under Sections 363/366/376 of I.P.C. and Section 3/4 of Prevention of Children from Sexual Offences Act, at Police Station Jaspur, District Udham Singh Nagar, and subsequently after investigation the police has also filed charge sheet in this matter. The application under Section 482 Cr.P.C. has been filed by the applicant praying for quashing the entire proceedings of Sessions Trial No.102 of 2014, arising out of First Information Report No.100 of 2014, which is being initiated after filing of the charge sheet under Section 363/366/376 of I.P.C. and Section 3/4 of Prevention of Children from Sexual Offences Act. 2. The deponent in the present miscellaneous application, however, is the same girl who is alleged to have been kidnapped and subsequently raped by the applicant. The case of the applicant is that the applicant and the alleged victim were in love and subsequently were married at Moradabad and the alleged victim, who is the deponent in his application, is his legally wedded wife. 3. In view of the above mentioned facts and circumstances, as an interim measure, it is provided that till the next date of listing further proceedings of Special Sessions Trial No.102 of 2014, arising out of First Information Report No. 100 of 2014, under Sections 363/366/376 of I.P.C. and Section 3/4 of Prevention of Children from Sexual Offences Act at Police Station - Jaspur, District Udham Singh Nagar, shall remain stayed. 4. State counsel has accepted notice for respondent no.1. Issue notice to respondent no.2. Steps to be taken within one week. Respondents shall file their reply within three weeks. 5. List this matter after four weeks in a daily cause list.
