JUDGMENT BISWANATH RATH, J.: In W.P.(C) No. 27915 of 2013 the order dated 30.9.3013 (Annexure-13) passed by the Principal Secretary to the Government of Odisha, Department of Higher Education pursuant to the judgment dated 24.2.2012 (Annexure-9) and in W.P.(C) No. 2733 of 2014 the said order dated 30.9.3013 (Annexure-12) passed by the Principal Secretary to the Government of Odisha, Department of Higher Education pursuant to the judgment dated 24.2.2012 (Annexure-11) passed by the State Education Tribunal, Bhubaneswar in G.I.A. Case Nos. 501 and 503 of 2011, are under challenge. 2. The judgment dated 24.2.2012 passed by the State Education Tribunal, Bhubaneswar in G.I.A. Case Nos. 501 and 503 of 2011 vide Annexure-9 to the W.P.(C) No. 27915 of 2013 and Annexure-11 to the W.P.(C) No. 2733 of 2014 were under challenge in this Court vide F.A.O. Nos. 186 and 187 of 2014. By judgment passed today in FAO Nos. 186 & 187 of 2014 this Court has already set aside the judgment dated 24.2.2012 (Annexure-9) in W.P.(C) No. 27915 of 2013 and Annexure-11 in W.P.(C) No. 2733 of 2014 passed by the State Education Tribunal, Bhubaneswar in G.I.A. Case Nos. 501 and 503 of 2011. Both the proceedings arose against common order and thus I decide both the matters by a common order. 3. Since the present impugned order emanates from the judgment which, this Court has already set aside, the present impugned orders, i.e., Annexure-13 in W.P.(C) No. 27915 of 2013 and Annexure-12 in W.P.(C) No. 2733 of 2013 automatically loose force. 4. Therefore, while setting aside the impugned orders in both the writ petitions passed by the respondent no.1, I allow both the writ petitions. 5. Both the writ petition succeed. However, there shall be no order as to costs.
