Judgment Sudhanshu Dhulia, J. Heard Ms. Pushpa Joshi, Senior Advocate assisted by Mr. B.S. Parihar, learned counsel for the applicant, Mr. P.S. Saun, Deputy Advocate General, for the State and perused the record. The applicant is in jail being implicated in F.I.R. No. 346 of 2014, which has been registered under Sections 452/376/377/506 of I.P.C., Thana Kashipur, District Udham Singh Nagar. The story as narrated in the First Information Report of rape has been elaborated in the statement of the prosecutrix – Kamla Devi, both under Sections 161 and 164 of Cr.P.C. Further the medical examination report, which was conducted on 27.07.2014, which also shows that she has sustained injuries on her breast and other parts of her body. Prima facie, this Court is of the view that it is not a case for bail. Accordingly, the bail application is rejected.
