JUDGMENT Mr. Tejinder Singh Dhindsa, J.:- This order shall dispose of the present petition filed under Section 439 Cr.P.C for grant of regular bail in case F.I.R. No.118 dated 7.10.2012 registered under sections 21/61/85 of the N.D.P.S. Act at Police Sadar Kaurthala, District Kapurthala. 2. Learned counsel for the parties have been heard. 3. As per prosecution version the petitioner was apprehended on 7.10.2012 and was found in possession of 260 gms. of intoxicating powder and as per report of the Chemical Examiner the same was found to be Diacetylmorphine to the extent of 64.17%. 4. In the light of notification issued by the Central Govt. under Section 2 of the N.D.P.S Act a quantity more than 250 gms of manufactured drug or preparation containing Diacetylmorphine is to be considered as commercial quantity. In the present case recovery is of 260 gms., which is marginally more than the commercial quantity. 5. Undisputedly, the petitioner is in custody since 7.10.2012 and the trial is still at the initial stage and no prosecution witness has been examined. 6. The petitioner is not involved in any other proceedings under the N.D.P.S Act. 7. A reference may also be made to an order dated 30.9.2013, passed by a Coordinate Bench of this Court in CRM No. M-26153 of 2013 titled as Hardeep Singh @ Deepa Vs. State of Punjab, wherein under identical allegations i.e. of recovery of 260 gms. of the same very intoxicating material, the benefit of regular bail had been granted. 8. Accordingly, the present petition is allowed. Bail to the satisfaction of Trial Court. 9. Petition disposed of. ---------0.B.S.0------------
