ORDER : S.C. Sharma, J. Heard with the consent of the parties. The petitioner before this Court has, filed this present writ petition being aggrieved by the order dated 2-8-13 by which the petitioner has been informed that his selection to the post of Constable (General Duty) has been cancelled. 2. This is a case in which the petitioner was acquitted in a criminal case, prior to the date he submitted his application form for the examination in question, i.e., on 7-1-12 and he has not disclosed the factum of his acquittal in the form, however, after he was selected, he was directed to submit a detailed form and there were specific columns in respect of criminal antecedents and the petitioner has submitted all minute details relating to the crime in question in which he was acquitted. A detailed police verification form was submitted by the petitioner on-19-4-12. It has also been brought to the notice of this Court that the petitioner was acquitted on 28-4-08 and he has categorically stated about his acquittal in the detailed police verification form submitted by him. The respondents have issued a show-cause notice on account of the discrepancy in the initial form and thereafter his candidature has been cancelled. 3. Respondents have admitted in the return that the petitioner has not suppressed material information while submitting Form 3, which is the police verification form and which contains all minute details. 4. Keeping in view the aforesaid fact that the petitioner himself, while submitting police verification form has categorically informed the authorities about his acquittal of the year 2008 by the Judicial Magistrate First Class, in respect of the Crime No. 39/2006, this Court is of the considered opinion that the impugned order deserves to be set aside and is accordingly set aside. 5. Resultantly, the respondents are directed to issue an appropriate appointment order in favour of the petitioner in case he is entitled for appointment as per his merit for the post of Constable General Duty. Respondents shall also grant him all consequential benefits except arrears of salary in the peculiar facts and circumstances of the case. 6. The aforesaid exercise of passing appropriate order, as directed, be concluded within a period of 60 days from the date of receipt of certified copy of this order. With the aforesaid, the present writ petition stands allowed.
