JUDGMENT : 1. Shri Mohan Parasaran, learned Solicitor General has filed an affidavit on behalf of Union of India. The same is taken on record. Along with the said affidavit, learned Solicitor General has filed two sealed covers. The first sealed cover contains the list of documents and information in respect of 18 individuals against whom investigations have been concluded by the Income Tax Department and prosecutions have been launched in 17 cases (one tax payer has expired). 2. The second sealed cover contains the names of 8 individuals with respect to whom the investigation is concluded and no evidence of tax evasion in terms of Indian tax laws was found. The documents and information received from the German Tax Authorities with respect to these 8 individuals is also being enclosed in the second sealed cover. 3. We do not intend to open these sealed covers. We first propose to discuss among ourselves. 4. Pursuant to the directions issued by us on the last date of hearing, Shri Anil Divan, learned senior counsel has handed over a cover containing the names of three former Hon'ble Judges of this Court who can be nominated as the Chairman and the Vice-Chairman of the Special Investigation Team that is constituted by this Court vide judgment and order dated 04.07.2011. A decision on this aspect will also be taken by us on the next date of hearing. Call the matter on 01.05.2014 at 4.00 p.m.
