Dharam Chand Chaudhary, J. (Oral) Learned Additional Advocate General has placed on record the police report and the Investigating Officer, ASI Ramesh Chand, I.O. Police Station, Nurpur, has produced the record. 2. Petitioner is an accused in FIR No. 32 of 2012, registered in Police Station, Nurpur, District Kangra, under Sections 420, 467, 471 and 120-B of the Indian Penal Code, with the allegation that he being a Director of SOSS Private Limited, grabbed the money in lacs of rupees invested by various persons in the company on the allurement that they will get various incentives in lieu of the investment so made. However, when such investor did not get any incentive they 2 inquired the matter and came to know that the accused-petitioner along with his co-accused, embezzled this amount by utilizing the same for their own benefits and thereby cheated the persons, who invested their hard earned money in the Company. It is seen that the principal accused, namely Raman Kumar along with other accused persons Rakesh Kumar and Sandeep Kumar stand already released on bail by this Court. The accused-petitioner was not available to the police for the purpose of interrogation, who allegedly absconded after registration of the FIR. He, however, has now joined the interrogation. Although he belongs to Orissa, yet, in order to restrict his movement and also to ensure his presence for the purpose of further investigation during the trial, appropriate conditions can be imposed upon him. Therefore, this application is allowed. It is ordered that in the event of arrest of the accused-petitioner in connection with the aforesaid case, registered against him in Police Station, Nurpur, he shall be released on bail subject to his furnishing personal bond in the sum of Rs.

It is ordered that in the event of arrest of the accused-petitioner in connection with the aforesaid case, registered against him in Police Station, Nurpur, he shall be released on bail subject to his furnishing personal bond in the sum of Rs. 1,00,000/- with one local surety in the like amount to the satisfaction of the arresting police officer/investigating officer and abiding by the following further conditions: That he shall:- (a) make himself available for the purpose of interrogation as and when required and shall co-operate with the Investigating Officer to conduct the 3 investigation in a manner so as to take it to its logical end; (b) not tamper with the prosecution evidence nor hamper the investigation of the case in any manner whatsoever; (c) not make any inducement, threat or promises to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or the Police Officer; and d) not leave the territory of India without the prior permission of the Court. 3. It is clarified that if the petitioner misuses his liberty or violates any of the conditions imposed upon him, the investigating agency shall be free to move this Court for cancellation of the bail. 4. Any observations made hereinabove shall not be construed to be a reflection on the merits of the case and shall remain confined to the disposal of this petition alone. 5. The application stands accordingly disposed of.
