Judgment Heard. 2. The petitioner, who is a practicing advocate, has filed this PIL for the relief that the respondents be directed to stop the use of oxitocin injections because the aforesaid hormone has adverse and ill effects on the health of citizens. 3. Oxitocin is a hormone. It is being produced under special circumstances under surface of brain. It is beneficial to women at the time of pregnancy and can also be used for injection into muscles. It is a schedule-H notified drug, which means it could be sold only on prescription of a registered medical/veterinary practitioner. The Drug Controller General of India has also issued instruction to all State Drug Controllers to regulate and monitor distribution of Oxitocin. 4. Parliament has also enacted an act namely Food Safety and Standards Act, 2006. Penalties have been prescribed under the Act and the Act defines 'unsafe food'. The petitioner is at liberty to submit complaint before the appropriate authority, if there are adverse effects or if the oxitocin is used in vegetables. 5. The Union of India in its return pleaded that the implementation of provisions of Food Safety and Standard Act, 2006 is the responsibility of the State Government. It is further submitted that the use of oxitocin is not allowed for the purpose to enlarging the size of vegetables and fruits or to increase the rapid growth of chickens. If there is any use of oxitocin for the aforesaid purpose, the information be submitted to the concerned Commissioner of Food Safety and he is under legal obligation to take necessary steps. 6. In this view of the matter, this Writ Petition is disposed of with the direction that respondent No.2 shall take appropriate measures to ensure that oxitocin hormone be purchased only on a prescription of registered medical/veterinary practitioner. The State authorities shall also ensure that it shall not be used for the purpose of enlargement of size or weight of vegetables or fruits neither it be used in rapid growth of chickens in poultry farms. 7. With the aforesaid directions, this petition is disposed of. No order as to costs.
