JUDGMENT Mr. M. Jeyapaul, J. (Oral):- Petitioners Randhir Singh @ Kaka and Jaswinder Kaur who are facing trial under Sections 302, 307, 450, 452, 326, 120-B, 109 and 148 read with Section 149 IPC and Section 25/27/30/54/59 of the Arms Act have filed the above titled respective petitions praying for regular bail having been in custody right from 24.12.2012, the date on which the occurrence took place. 2. The allegation as against petitioner Randhir Singh @ Kaka is that he raised lalkara instigating the other accused to commit the crime. As against petitioner Jaswinder Kaur, the allegation is that her gun was used by co-accused Jasvir Singh to cause injury to the complainant and also to cause death to the father of the complainant. 3. Heard the submissions on either side. 4. Learned counsel appearing for the complainant would object to granting bail on the ground that the main accused in this case, namely, Jasvir Singh is at large. The sister-in-law of Jaswinder Kaur is also absconding. Further the case has been taken up for trial and the trial would be over shortly. 5. I heard the submission made by learned AAG, Punjab who also objects to granting bail to these petitioners as core accused are absconding and the trial would be completed shortly. 6. The above allegations as against these petitioners are found to be not so grave. They have been in custody for the past more than 1 year and 3 months. Two of the co-accused who stand on the same footing of Randhir Singh @ Kaka were also released on bail by this Court. It is true that 12 witnesses had already been examined. But it is found that total witnesses cited by the prosecution are 37 in number. So, it would take some time for the trial to be concluded. 7. For all these reasons, I find that the petitioners have made out a case for grant of regular bail. 8. Therefore, bail to the satisfaction of CJM/Duty Magistrate, Sangrur. ---------0.B.S.0------------
