JUDGMENT Mr. M. Jeyapaul, J.:- The petitioner has moved this petition under Section 439 of the Code of Criminal Procedure seeking regular bail. 2. The petitioner who has been in custody for the past 10 months is facing trial for the offence under Section 304 read with Section 34 of the Indian Penal Code. 3. Heard the submissions made on either side. 4. The case is based on circumstantial evidence. No recovery has been effected from the petitioner. The allegation is that the petitioner gave leg and fist blows to the deceased. The co-accused Satish who stands on the same footing was already released on bail by this court. It may take some time for the trial to be concluded. In view of the above, the petitioner has made out a case for grant of bail. 5. Therefore, without expressing any opinion on the merit of the case, the petitioner is ordered to be released on bail on his furnishing bail bond to the satisfaction of CJM/Duty Magistrate, Jind. ---------0.B.S.0------------
