JUDGMENT Virendra Vikram Singh,J.: - By moving the present application under section 482 Cr.P.C., order dated 4.6.2013 passed by Judicial Magistrate, Jewar, district Gautam Buddh Nagar in protest petition No. 241 of 2010 (Brijendra vs Gajendra and others), under sections 420, 467, 468, 471 and 120-B IPC, PS Jewar, district Gautam Budh Nagar is under challenge. 2. Heard learned counsel for the applicants and learned Additional Government Advocate for the State. 3. By the impugned order, the learned court below has rejected the final report and has ordered for further investigation. 4. It has been argued that the facts mentioned in the FIR are false and the same has been found to be baseless after investigation, hence the trial court should not have ordered for further investigation in the matter. 5. After the submission of final report, it is obligatory for the court to send notice to the complainant, this aspect is not denied. The complainant of the case moved protest petition and on receiving such protest petition, the court concerned may either accept the final report or reject it. It has still the option to order for investigation or the protest petition may be ordered to be treated as complaint. The court below has adhered to one of the permissible orders within its jurisdiction after giving ground for passing such orders. 6. There does not appear any abuse of process or illegality in the impugned order for the indulgence of this Court. 7. The prayer for quashing the order dated 04.06.2013 is hereby declined. Accordingly, the application is rejected.
