JUDGMENT Heard learned counsel for the petitioners. 2. Petitioners have filed this petition for a direction upon the court of Judge Small Causes Court Aligarh to decide Original Suit No. 1107 of 2008 (Mohd. Yaseen and others Vs. Salma Ara) within a time bound period. 3. A Division Bench of this Court in 2010 (1) ADJ 531 (DB) Km. Shobha Bose Vs. Judge Small Causes Court has held that direction for speedy disposal should only be given where the Court is satisfied that the court below is purposely avoiding to dispose of the suit for any oblique motive and the parties should ordinarily be relegated before the Court seized with the matter to take appropriate decision depending upon the pendency of other cases and considering all other relevant circumstances. 4. There is no averment or material that the court is avoiding decision of the case. 5. In view of the above decision, it is not proper to issue any direction for time bound disposal of the suit. 6. However, petitioners are at liberty to move suitable application before the court concerned for expeditious disposal of the suit and in case any such application is moved the court will consider it and do all that is necessary for expeditious disposal of the suit. Petition is disposed of accordingly.
