Judgment A.M. Sapre, J. Heard B. Sharma, learned counsel for the applicant-review petitioner and Mr. R. Dubey, learned Standing Counsel, Finance. Counsel for the petitioner is permitted to withdraw this petition with a liberty to file a fresh one on the same cause of action because admittedly it is filed to challenge the order dated 19.12.2013 passed by the Board of Revenue (Annexure-14) but surprisingly there is no prayer made in the petition to challenge this order. In view of this infirmity in filing the petition pointed out to the learned counsel for the petitioner, he seeks permission to amend the petition instead of withdrawing and file a fresh one. We, however, do not consider it apposite to accept the prayer for amendment and instead permit him to withdraw and file a fresh one as per rules. In case if any such petition is filed, the same will be decided in accordance with law. Misc. case is disposed of.
