JUDGMENT Ashwani Kumar Singh,J.: - Heard learned counsel for the petitioner and learned Additional Government Advocate. 2. By means of this petition, the petitioner has prayed for quashing the entire proceedings of criminal case no. 1734 of 2008(State versus Dr. Prayas Saxena) arising out of case crime no. 85 of 2007 under Sections 498A, 323, 342, 504, 506 I.P.C. and Section 3 /4 D.P. Act, police station Mahila Thana, district Lucknow pending in the court of Special Additional Chief Judicial Magistrate, C.B.I.(A.P.), Lucknow. 3. In pursuance of order dated 3.2.2014, Smt. Shashi Kanti opposite party no. 2 is present. Shri Vimal Shukla, Advocate has filed power on behalf of opposite party no. 2 and has identified her. 4. Learned counsel for the petitioner states that either parties have entered into compromise. 5. On being asked, Smt. Shashi Kanti opposite party no. 2 states that though she had initiated criminal proceedings against her husband Prayas Saxena under Sections 498A, 323, 342, 504 and 506 I.P.C. and Section 3 /4 D.P. Act but she does not want to proceed with the case. It is submitted that the petitioner and opposite party no. 2 have amicably settled their matrimonial dispute. 6. Considering the submission of learned counsel for either parties and also that of opposite party no. 2 and in view of the law laid down by the Hon'ble Supreme Court in the case of B.S. Joshi v. State of Haryana reported in 2003(4) SCC 675 and also in the case of Gian Singh v. State of Punjab and another reported in 2012(SCC) Crl. Law Journal 4934, this petition is allowed and entire proceedings of criminal case no. 1734 of 2008(State versus Dr. Prayas Saxena) arising out of case crime no. 85 of 2007 under Sections 498A, 323, 342, 504, 506 I.P.C. and Section 3 /4 D.P. Act, police station Mahila Thana, district Lucknow pending in the court of Special Additional Chief Judicial Magistrate, C.B.I.(A.P.), Lucknow are hereby quashed.
