Judgment They are heard. This is second application under section 439 Cr.P.C. 2. Earlier bail application filed by the applicant being MCRC 3429/2014 has been dismissed by this Court vide order dated 28/4/2014 with the following observation. “Shri D.S.Kushwaha, Advocate for the applicant. Shri Raghvendra Dixit, Public Prosecutor for the respondent/State. Counsel for the applicant does not want to press this application at this stage. He seeks liberty to file application after filing of the charge sheet. Application is dismissed as withdrawn with the liberty as prayed for by the counsel for the applicant.” 3. Applicant is in custody since 09th April, 2014 in connection with Crime No.264/2013 registered for the offences punishable under sections 420,467, 468 and 120-B IPC, Section 45(5) of RBI Act and Sections 3(1)(2)(4) of MP Nikshepakon Ke Hiton Ka Sanrakshan Adhiniyam, at Police Station Thathipur, District Gwalior. Counsel for the applicant submits the applicant is a lady aged 41 years and is in custody for about one and half months. He also submits that challan has been filed in the case. Hence, it is a changed circumstance. Considering the facts and circumstances of the case, and the fact that the applicant being a lady aged 41 years is in custody since 9/4/2014 and challan has already been filed in the case, without expressing any opinion on the merits of the case, we allow the applicant and direct that the applicant be released on bail subject to her furnishing a personal bond in the sum of Rs.one lac with on solvent surety in the like amount to the satisfaction of the Trial Court.
