Judgment Heard on this first bail application preferred under Section 438 of Cr.P.C. on behalf of the applicant Amar Singh, for grant of anticipatory bail. 2. The case diary has been perused. 3. The applicant is apprehending his arrest in connection with Crime No.60/2014 registered at police station Seondha, District Datia for the offences punishable under Sections 376(2)G of IPC. 4. On perusal of case diary it seems that incident occurred between 27/02/2014 to 05/03/2014. After a period of more than 8 days, FIR was lodged on 13/03/2014 by the prosecutrix. 5. On perusal of FIR, it is also clear that prosecutrix is married lady having some relation with the applicant, Amar Singh and she has lived with the applicant for more than 8 days. 6. Prayer for bail was opposed by the learned Public Prosecutor. 7. After taking into consideration the facts mentioned above, this application is allowed. It is directed that in the event of arrest, the applicant shall be enlarged on bail on his furnishing a personal bond in the sum of Rs. 1,00,000/- (Rs. One Lac only) with a surety bond in the like amount to the satisfaction of Arresting officer/competent Court. The applicant shall make himself available for interrogation by a police officer as and when required and he will co-operate in the investigation. He shall further abide by the other conditions enumerated in sub-section (2) of Section 438 of Cr.P.C. C.C. as per rules.
