Judgment Heard. 2. On behalf of the applicants, this petition is preferred under Section 438 of Cr.P.C. for grant of anticipatory bail to them, as they are under apprehension of their arrest in connection with Crime No.251/2014 registered at Police Station Bairagarh, District Bhopal for the offence punishable under Sections 406 and 506-B of I.P.C. 3. Having heard the counsel, keeping in view the arguments advanced, after perusing the case diary, taking into consideration the circumstance that long before on behalf of the complainant wife of the applicant No.1, a first information report was lodged against the applicants for the offence under Section 498-A of the I.P.C. in which she had not narrated any allegation with respect of the offence under Sections 406 and 506-B of I.P.C. but after granting anticipatory bail by this Court to the applicants in such earlier case vide order dated 17.12.2013 in M.Cr.C.No.16314/2013, the impugned first information report with respect of the aforesaid offence was lodged by the complainant against the applicants, so in the lack of appropriate explanation why such allegation was not made in the earlier FIR, in such circumstances, without expressing any opinion on merits of the matter, this petition is allowed. 4. In pursuant to aforesaid, it is directed that in the event of arrest of the applicants or any of them in connection with the above mentioned crime on furnishing a personal bond of Rs.20,000/- (Rs.Twenty thousand) alongwith one surety of the like amount by each of them to the satisfaction of the arresting/investigating officer, they shall be released on bail. Such bail has been granted subject to terms and conditions enumerated under Section 438(2) of Cr.P.C. 5. In view of disposal of this petition, I.A.No.10145/2014, applicants' application for grant of ad interim anticipatory bail does not require any further consideration, hence the same is disposed of.
