JUDGMENT Mrs. Sabina, J.:- Petitioner has filed this petition challenging the orders dated 8.4.2012 (Annexure P-2) and 13.6.2012 (Annexure P-1) whereby application moved by the petitioner under Order 39 Rule 1 and 2 of the Code of Civil Procedure, 1908, was dismissed. 2. I have heard the learned counsel for the parties and have gone through the record available on the file carefully. 3. In the present case, admittedly, the property in question belongs to the Punjab Wakf Board. Petitioner as well as respondent claimed to be in possession of the premises in question on the basis of the lease deeds executed in their favour by the Punjab Wakf Board. In these circumstance, it would be just and expedient to direct the parties to maintain status quo with regard to possession, as at this stage without the evidence having been led by the parties in support of their respective pleas, it cannot be ascertained as to whether the petitioner is in possession of the property in question or the respondent is in possession of the property in question. 4. Accordingly, impugned orders dated 8.4.2012 (Annexure P-2) and 13.6.2012 (Annexure P-1) are set aside. Parties are directed to maintain status quo with regard to possession over the property in question during the pendency of the suit. 5. Petition stands disposed of accordingly. ---------0.B.S.0------------
