Judgment Heard. 2. On behalf of the applicant, this petition is preferred under Section 438 of Cr.P.C. for grant of anticipatory bail to him, as he is under apprehension of his arrest in connection with Crime No.120/2014 registered at Police Station Anooppur, District Anooppur for the offence punishable under Sections 354, 323 of IPC and Section 3(1)(xi) of the S.C. & S.T. Act. 3. In the course of arguments, in response of some query of the Court based on the available material and the case diary, instead to argue further, applicant's counsel seeks permission to withdraw this petition as not pressed with a further prayer for appropriate direction to the concerning Special Court (Constituted under the S.C. & S.T. Act)/Sessions Court that after surrendering the applicant, if any application under Section 439 Cr.P.C. is filed on his behalf then the same be considered and adjudicated within three days from the date of filing the same. 4. Considering such prayer, this petition is hereby dismissed as withdrawn and not pressed. However, considering oral prayer, it is directed that after surrendering the applicant, if any application under section 439 Cr.P.C. is filed on his behalf either before the aforesaid Special Court or Sessions Court then such Court shall consider and decide the same on its own merits within three days from the date of filing the same.
