Judgment Heard. 2. On behalf of the applicant, this petition is preferred under Section 438 of Cr.P.C. for grant of anticipatory bail to her, as she is under apprehension of her arrest in connection with Crime No.119/2014 registered at Police Station AJAK, Harda for the offence punishable under Sections 341, 294, 506, 323 read with 34 of I.P.C. and Section 3(1)(x) of the S.C. & S.T. (Prevention of Atrocities) Act. 3. Having heard the counsel, keeping in view the arguments advanced, I have carefully gone through the case diary as well as impugned rejection order. On perusing the first information report, I have not found any specific word of the circumstances in which prima facie it could be said that with intention to humiliate the complainant belonging to the caste covered under the S.C. & S.T. Act, the alleged act was committed by the applicant. So in such premise, this case prima facie appears of sections 341, 294, 506 and 323 of I.P.C. and out of them various sections are bailable. So considering overall circumstances of the case, without expressing any opinion on merits of the matter, this petition is allowed. 4. It is directed that in the event of arrest of the applicant Sanyogita Bai in connection with the above mentioned crime on furnishing a personal bond of Rs.15,000/- (Rs.Fifteen thousand) alongwith one surety of the like amount by the applicant to the satisfaction of the arresting/investigating officer, she shall be released on bail. Such bail has been granted as per the terms and conditions enumerated under Section 438(2) of Cr.P.C. C.C.as per rules.
