JUDGMENT Mr. Naresh Kumar Sanghi, J.:- Prayer in this petition is for grant of regular bail to the petitioner, Geeta wife of Lachhman Dass, resident of House No.8, Lasuri Mohalla, Basti Danishmandan, Jalandhar, who has been booked for having committed the offences punishable under Sections 109, 306/511, 354, 354-D and 506, IPC, in a case arising out of FIR No.220, dated 21.10.2013, registered at Police Station, Division No.5, Jalandhar. 2. Learned counsel contends that there is no evidence connecting the petitioner with the alleged suicide of Pooja; mischiefs of Sections 354 and 354-D etc. are not attracted qua the petitioner; petitioner is a lady and mother of five children including three minor; she is behind the bars from 21.10.2013 and after completion of investigation, the chargesheet has already been submitted before the learned court below and that further incarceration of the petitioner is not of any worth. 3. Learned counsel for the State, on instructions from HC Balwinder Singh of Police Station, Division No.5, Jalandhar, very fairly concedes that during investigation there was not an iota of evidence connecting the petitioner with the alleged offence but at the time of recording her statement under Section 164, Cr.P.C., Pooja had stated that at the behest of her cousin, everything was got done. 4. I have heard learned counsel for the parties and with their able assistance gone through the material available on record. 5. The applicability of the mischiefs of the offences for which the petitioner has been booked would be a moot point during the course of trial. Petitioner, who is mother of five children including three minor, is behind the bars from 21.10.2013. After completion of the investigation, the chargesheet (report under Section 173, Cr.P.C.) has already been submitted, however, charges have not yet been framed. The trial would take sufficient long time to conclude. 6. In view of the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner- Geeta wife of Lachhman Dass, resident of House No.8, Lasuri Mohalla, Basti Danishmandan, Jalandhar, is ordered to be released on bail during pendency of the trial subject to her furnishing bail bonds to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Jalandhar. ---------0.B.S.0------------ ----------------
