Judgment : D.H. Waghela, J. 1. As recorded in the earlier order dated 27-06-2014, the petition was sought to be withdrawn. However, during the course of hearing, learned counsel for the CHESCOM, joined as respondent herein, has expressed willingness to pay the sum of Rs.2,25,175/-to the respondent. The respondent, Mr.N.Sridhar who lost his four year old son on account of falling of a pole installed by the CHESCOM is now represented by learned counsel, Mr.G.M.Ananaa, appointed by the High Court Legal Services Committee and he has appeared to assist the Court in making further order. 2. Learned counsel, Mr.Anand, has verified the identify of the respondent who is personally present before the Court and has requested to disburse the amount offered by the CHESCOM to the respondent in such manner that the additional lumpsum compensation as recommended by the State Human Rights Commission is not frittered away and as could be wisely and in an orderly manner be utilised for the welfare of the family of the respondent. 3. Accordingly, learned counsel for the CHESCOM is requested to see that the cheque in the name of the respondent for the sum of Rs.2,25,175/-is deposited in the account of the respondent, which he is stated to have in the State Bank of India at Srirangapatna Branch. Out of the amount of cheque being credited in the account of the respondent, the sum of Rs.2,00,000/-shall be converted to fixed deposit certificate for the term of three years in the joint name of the respondent and his wife, Smt. V.Indira. The interest accruing upon the fixed deposit shall be credited for the term of three years at quarterly rests into the account of the respondent and at the end of the term of the fixed deposit, the amount may be disbursed to the respondent and his wife in equal proportion for utilising the amount as they think fit. The remaining amount to be credited into the account of the respondent, that is Rs.25,175/-shall remain credited into the account of the respondent for the purpose of using the amount for the welfare and education of other children who are stated to be two daughters. 4.

Learned counsel, Mr.Rudragowda, has assured the Court that a responsible officer of the CHESCOM will accompany the respondent to the branch of the bank as aforesaid, with a copy of this order, for its proper execution and help the respondent in understanding the process of disbursement by the bank. 5. The cause title of the petition shall be amended to show full name of the CHESCOM as respondent No.2. 6. Subject to the above direction, the petition is dismissed as withdrawn, with no order as to cost. 7. A copy of this order shall be furnished immediately to learned counsel for the CHESCOM.
