Learned counsel for the appellant has filed a Memo before this Court stating that the respondent had accepted the payment of settlement amount and withdrawn the Company Petition in C.P.No.362 of 2003 on 18.6.2013. As such, nothing survives for adjudication in O.S.A.No.67 of 2009 and the appeal may be dismissed as withdrawn. 2. In view of the fact that nothing survives for adjudication in the present appeal and also taking note of the fact that a Memo dated 5.11.2013 has been filed before this Court today to that effect, recording the said facts this Court dismisses O.S.ANo.67 of 2009 as withdrawn. 3. In the result, the appeal is dismissed as withdrawn. No costs. Consequently, connected MP is closed.
