S.K.GANGELE, S.K.PALO

body2014
Judgment: 1. Heard on IA No. 2843/2014, an application for condonation of delay. 2. There is a delay of 674 days in filing the appeal. 3. It is mentioned in the application that other persons who had filed writ petitions, also assailed the order of writ Court in Writ Appeals. Thereafter, this Court allowed Writ Appeal No. 233/2012 vide judgment dated 24-01-2014. Consequently, the appellant came to know about the judgment. Thereafter, he has filed the present appeal. The appellant did not have sufficient money to engage the counsel. Hence, there was delay in filing the appeal. 4. After perusal of the application, in our opinion, the reasons mentioned in the application, are not sufficient to condone the delay in filing the appeal, as held by Hon'ble the Supreme Court in the case of Easha Bhattacharjee vs. Managing Committee of Ragunathpur Nafar Academy and Others reported in (2013) 9 SCR 782. Consequently, the application (IA No. 2843/2014) for condonation of delay, is hereby dismissed and the appeal is also dismissed.
