body2014
Judgment : M. Jaichandren, J. 1. Heard the learned counsels appearing on behalf of the parties concerned. 2. This Writ Petition has been filed praying that this Court may be pleased to issue a Writ of Mandamus directing the respondent to pass orders on the application of the petitioner, dated 9.12.2013, and the reminder, dated 26.2.2014, for the issuance of a Community Certificate to the petitioners' minor children, namely, [1] S.Gokula Gopalakrishnan, [2] S.Nishakumari and [3] S.Nithya, stating that they belong to 'Kurumans', a Scheduled Tribe Community, based upon the Community Certificate already issued to the petitioner and his family members. 3. At this stage of the hearing of the Writ Petition, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if a direction is issued to the respondent to pass orders on the application of the petitioner, dated 9.12.2013, on merits and in accordance with law, within a time frame specified by this Court. The learned Government Advocate appearing on behalf of the respondent has no objection for this court passing such an order. 4. In such circumstances, we find it appropriate to direct the respondent to consider the application of the petitioner, dated 9.12.2013, if it is otherwise in order, and dispose of the same, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. The petitioner shall furnish a copy of the application, dated 9.12.2013, to the respondent, along with a copy of this order. However, it is made clear that we have not expressed any opinion on the merits of the matter. The Writ Petition is disposed of, with the above directions. No costs.
