ORDER In this writ petition, the petitioner is seeking direction to provide posting as per option given by him after selection on the basis of merit on the post of Teacher Grade-III. The Coordinate Bench of this Court at Jaipur Bench Jaipur gave certain direction in case of Vikram Chand Vs. State of Raj., SB CWP No.14215/2012 decided on 03.10.2012 to consider the prayer for posting as per option but in the opinion of this Court, transfer and posting are incident of service and there is prerogative of the employer to take work from the employees as per the requirement of work, therefore, if any option is taken from employee to give posting as per availability of post that cannot be a ground to claim posting as a matter of right. It is true that options were invited from the candidates at the time of selection but that option given by the petitioner cannot create any right for the employee to claim posting. In this case, competent authority after considering option of the petitioner not provided posting as per his option, therefore, it is prayed that respondents may be directed to provide posting as per option and merit. In the opinion of this Court, if any contravention of policy is made by the competent authority then petitioner is required to raise his grievance before the said authority. This Court while exercising power under Article 226 of the Constitution of India should not interfere in the administrative work to provide posting as per choice of the employees. In view of above, this writ petition is disposed of with liberty to the petitioner to raise his grievance before the respondents by way of filing representation and in the event of receiving such representation filed by the petitioner within one month, it is expected that the representation will be decided by the respondents strictly in accordance with law.
